With Augusta having the nation’s largest burn center, I have seen the courage and dedication it takes to overcome the severe medical problems caused by a fire. It also costs a lot of money. That money is what the insurance companies want to keep in their pocket and out of yours.
A little background. Burns are unlike many other injuries. Aside from psychological damage, there can be lifelong severe pain plus significant scarring and disfigurement. I have had clients who have had so many surgeries that they have almost lost count. In the worst cases, scarring is permanent and can affect their ability to find meaningful employment plus dramatically affect their quality of life.
As lawyers, we must prove that the burns were the result of someone else’s negligence. It could be something that was done incorrectly or something that was not done at all. Proving fault in a burn case can be especially tricky since often the evidence is destroyed in the fire.
Georgia law does provide one substantial benefit. If a defective product caused the fire, we do not have to prove that the company meant to injury anyone. The manufacturers and the sellers can be held to “strict liability.” Under this rule, we must prove 3 things: they made the product, the product was defective, and the product caused the injuries. If we do that, they generally must pay to make the victim whole, as close as possible.
